Under the direct supervision of the UNODC Anti-Corruption Adviser, the consultant will be responsible for the following key tasks: Phase 1- - A report is produced summarizing the a desk review of Samoa IRM First Cycle executive summary and full report, Samoa UNCAC Post-Implementation Review Status; Samoa's legal framework to identify gaps with the existing international standards and best practices; using the Legislative Guide for the Implementation of UNCAC and the Technical Guide to the UNCAC; - A report is produced summarizing the conduct of consultations with relevant stakeholders on the outcome of the review under subparagraph 7.a.i. in consultation with the Review Team - In consultation with the review team, recommendations are drafted on necessary legislative amendments in order to comply with the mandatory recommendations in the Implementation Review Mechanism, first cycle review UNCAC. The finding of the second cycle review emanating from the discussion during the country visit in March 2024, can be also integrated as required. The set of legislative drafting instructions shall be clear on matters to be included in relevant legislation, and any other subsidiary laws/Regulations, if required. Phase 2 - In coordination with the review team draft is developed amending provisions based on the legislative drafting instructions developed in Phase 1. -Monthly terminal report are developed as well as ad-hoc status and progress reports are developed To support the review the Samoa Police, Prisons and Correction Services (SPPCS) will establish a Review Team consisting of: a. Team Leader (senior SPPCS Officer), b. Legal Expert (senior representative of the AGO), c. SPSC Representative(s); and d. Technical Advisor/Consultant.

Duties and Responsibilities
Corruption remains a significant obstacle to development globally and throughout the Pacific region. The United Nations Convention against Corruption (UNCAC) provides a comprehensive framework to strengthen anti-corruption frameworks in the region. All 14 Pacific Island countries have ratified this universal and the only globally binding treaty, which includes the mechanism for the review of implementation of UNCAC (UNCAC Implementation Review Mechanism). Samoa acceded to the UNCAC on 18 April 2018. As per the information provided during the first cycle review; the anti-corruption framework comprises provisions from several laws, notably the Crimes Act 2013, the Criminal Procedure Act 2016, the Extradition Act 1974, as amended in 1994, the Mutual Assistance in Criminal Matters Act 2007, the Police Powers Act 2007, the Proceeds of Crime Act 2007 and the Money-Laundering Prevention Act 2007, as amended in 2018. Relevant institutions in the fight against corruption include the Public service Commission, the Office of the Ombudsman, the Office of the Attorney General, the Samoa Audit Office, the Samoa Police Service, the Samoa Transnational Crime Unit and the Samoa Financial Intelligence Unit. As a signatory of the Convention, Samoa promotes, strengthens, facilitates and implements measures to prevent and combat corruption more efficiently and effectively. These measures include, but are not limited to: a. reviewing policies and laws to ensure they are aligned with the recommendations of UNCAC; b. developing and integrating international standards into domestic law and practice; c. promoting integrity, accountability and proper management of public resources. The Pacific Islands Forum Secretariat ("PIFS") in their circular No. 3/23 have committed to provide support to PIFS member countries, to operationalize the 2020 Teieniwa Vision. The Government of Samoa is the first country availing of this possibility and requesting support to review and recommend necessary amendments to the relevant legislation in Samoa, in particular, the Crimes Act 2013.
Qualifications/special skills
• Minimum 7 years of relevant progressively responsible professional work experience in law and legislative reform is required • A significant experience in anti-corruption, good governance, and transnational crimes work at the national level is required; • Demonstrated experience partaking in high-level participative processes with national and international stakeholders (Government, State Institutions, CSOs, UN agencies) is required • Familiarity with UNCAC and other international, regional, and national anti-corruption frameworks is required; • Experience in drafting documents for a legal and non-legal audience is required; • Previous professional experience with the United Nations or other International Organizations is desired;
Languages
English and French are the working languages of the United Nations Secretariat. For this position, fluency in English, with excellent drafting and communication skills, is required. Knowledge of another United Nations official language is an advantage. Proficiency in Samoan language is required.
