    Country: Laos

    Description of the Assignment: Workplan – EPR Policy Gap Analysis

    Task 1: Preparation and Inception Phase

    • Meet with NPAP and key stakeholders (government agencies: MAE, MoIC, MoF, industry: Coca Cola, Lao Brewery, Heineken, Unilever, recyclers: Lao Chaluen, NGOs: SwissContact, WWF, GGGI, ADB, World Bank, EU).
    • Review existing national policies and legal frameworks related to EPR, solid waste management, producer responsibility, import regulations, and environmental protection.
    • Conduct a literature review of regional/international EPR systems (e.g., EU, Japan, South Korea, Thailand, Vietnam).
    • Develop detailed methodology for policy gap assessment, benchmarking, and stakeholder mapping.
    • Design data collection tools (policy review matrices, interview guides, assessment criteria).
    • Coordinate with government focal points for data access and institutional interviews coordination.

    Deliverable 1: Inception Report including: Workplan and methods, Analytical framework, Data collection tools, Structure of final report and timeline

    Task 2: Data Collection and Analysis

    2.1 Policy and Legal Review

    • Review existing laws, decrees, regulations, and institutional mandates related to:
      • Producer responsibility
      • Waste collection and recycling
      • Licensing, monitoring, and enforcement
      • Import/export and product standards
      • Informal sector roles
    • Analyze how current legislation aligns with standard EPR principles (polluter-pays, producer responsibility, traceability, circularity).

    2.2 Stakeholder Interviews and Consultations

    • Conduct structured interviews with:
      • Government agencies
      • Manufacturers, importers, and distributors
      • Retailers
      • Waste management companies
      • Recyclers and informal sector groups
      • Civil society and technical partners
    • Assess:
      • Stakeholder readiness
      • Perceived barriers
      • Capacity gaps
      • Data availability

    2.3 Institutional and Market Assessment

    • Map current waste management system flows (collection, sorting, recycling, disposal).
    • Assess coverage and capacity gaps in:
      • Data and monitoring
      • Financial mechanisms
      • Incentives and industry participation
      • Extended product chain traceability

    2.4 International Benchmarking

    • Compare national situation against:
      • Best-practice countries
      • Global frameworks (OECD, ASEAN guidelines)
    • Identify relevant models (e.g., PRO systems, eco-modulated fees, take-back schemes).

    2.5 Gap Identification and Prioritization

    • Identify:
      • Legislative and policy gaps
      • Operational challenges
      • Institutional capacity needs
      • Financial and monitoring weaknesses
    • Develop a prioritized list of gaps with justification (impact, urgency, feasibility).

    Deliverable 2: Draft EPR Policy Gap Analysis Report including: Findings from data collection, Policy and institutional analysis, Benchmarking results, Initial recommendations.

    Task 3: Validation and Finalization

    • Present draft findings to NPAP, government and stakeholders.
    • Collect written and oral feedback.
    • Revise report based on stakeholder comments.
    • Prepare presentation slides summarizing:
      • Key findings
      • Policy gaps
      • Recommendations and implementation pathways
    • Support the organization of a validation in a consultation workshop.

    Deliverable 3: Final EPR Policy Gap Analysis Report including: Validated findings, Prioritized policy and system gaps, Recommendations for legal reform, institutional strengthening, and implementation roadmap, and Slide deck and presentation delivered at the validation workshop.
